Applicants Classified as Conditional Immigrants

a. The administration        
        a) of the Immigration Marriage Fraud Amendments of 1986

1) falls mostly
        a) on the DHS.

b. The primary responsibility
        a) of consular officers

1) is
        a) to identify,
                i) at the time of visa issuance,
                ii) marriages
                        A) of less than two years
                        B) which have been the basis of petition approval.

If an applicant's basis

   is a marriage

        a) normally entitled to
                i) IR1, IR2,
                ii) F21, F22, F23, F24, F25,
                iii) F31, F32, or F33
                        A) classification

1) will be granted conditional status

        b) CX1, CX2, CX3,
        c) C24, or C25,
                i) respectively)
                ii) at the time of visa issuance
2) if:

        (1) The basis
                i) for immigration

            is a marriage
                i) to a petitioner,

1) must include a notice of conditional status.

The text of the notice is to be followed
        a) verbatim:

        If,
                i) at the time of admission to the United States
                ii) you will not have celebrated the second anniversary
                        A) of your marriage,
                                I) which is the basis of your immigrant status,

        1) you are subject to the provisions of section 216
                i) of the Immigration and Nationality Act.

        Under the provision,

        1) you will be granted conditional permanent residence
                i) by an officer of the U.S. Citizenship and Immigration Services (USCIS)
                ii) at the time of your admission to the United States.

        As a result,

                a) you and
                b) your spouse

        1) must file a joint petition
                i) with the Immigration and Naturalization Service
                i) to have the conditional status removed.

        The petition must be filed
                i) within the 90day period
                        A) immediately preceding the second anniversary

        a) with information
                i) that is helpful to the immigration officer
                        A) at the port of entry
                        B) upon the applicants admission to the United States.

The Immigrant Visa Overseas (IVO) system includes most common annotations
        a) in a drop down list, or
        
1) annotations can be manually entered
        a) using up to 44 characters
                i) per line.

b. Indicate any waivers
        a) approved by USCIS
        b) by annotating the visa.

IVO includes dropdown annotations
        a) for most waivers
                i) that you may use and edit, if necessary.

c. Because a beneficiary may not precede the principal applicant
        a) in entering the United States,

1) indicate
        a) if the applicant is a beneficiary
                i) accompanying or
                ii) following to join
                        A) the principal applicant.

You should use the IVO dropdown annotation:

         Valid

        1) only if Acc/FTJ Father/Mother/Spouse.

Annotate the MRIV
        a) for derivative beneficiaries
        b) to inform both
                i) the applicant and

Passport Waivers

a. If the passport requirement
        a) for an immigrant

    is waived
        a) under 22 CFR 42.2,

1) you should annotate the IV MRV foil
        a) to indicate the waiver.

This will help
        a) the carriers and
        b) the port of entry (POE)
                i) determine
                        A) if an immigrant
                                I) without a valid passport

                            is properly documented.

For example,

if the passport is waived
        a) in the case of an immigrant
                i) who is the spouse
                        A) of a U.S. citizen,

1) the annotation should read:

        PASSPORT
                i) NOT REQUIRED
                        A) PER 22 CFR 42.2(a).

b. If a passport is not required
        a) under an individual waiver,

1) the annotation should contain a reference
        a) to 22 CFR 42.2(g) as well as
        b) to the date and number
