Following is
        a) an explanation
                i) of each element and
        b) how you can prove your case.

1.) How can I prove that my marriage is ��good faith�� and I did not get married just to get immigration papers?

There are several ways
        a) to prove this.

The following documents are examples
        a) of what you can provide
                i) as proof
                        A) that your marriage was in good faith.

Please note that
        a) this list is not exhaustive,

1) you may have other documents
        a) that prove your marriage was in good faith.

        a. A ��personal declaration��
                i) in which you describe,
                        A) in great detail,
                        B) how you met your spouse,
                        C) why you got married, and
                        D) the feelings
                                I) that you
                                        (a) had or
                                        (b) still have
                                                (i) towards him or her, and
                        E) why.

        b. If you and your spouse have a child or children
                i) together,

                1) present the birth certificate
                        A) for each child.

        c.         i) Wedding pictures and/or
                ii) photographs
                        A) of other moments
                                I) when
                                        (a) you and your spouse, and/or
                                        (b) other members of your families and
                                        (c) friends

                                           have been together.

        d. Declarations
                i) (formal letters)
                ii) from people
                        A) who know
                                I) you and
                                II) your spouse and
                        B) who can affirm that
                                I) your marriage was based on
                                        (a) sentimental or
                                        (b) cultural
                                                (i) ties,
                        C) who witnessed your marriage ceremony or
                        D) who knew you
                                I) as a married couple.

                These letters should include
                        A) as many details as possible.

        e. Letters
                i) that you received
                        A) from your spouse
                        B) while you were
                                I) dating,
                                II) separated, or
                        C) during any other stage
                                I) of your relationship.

        f. Letters
                i) from people
                        A) addressed to both you and your spouse, or
                ii) in which the person
                        A) who wrote the letter

                   refers to both of you as a couple.

        g. Papers
                i) with the names of both you and your spouse
                ii) that show that
                        A) you bought
                                I) a car,
                                II) a house,
                                III) furniture, or
                                IV) something else together.

        h.         i) A rental agreement
                        A) for your house or apartment
                        B) with both of your names on it, or
                ii) a letter
                        A) from
                                I) the building manager or
                                II) owner
                        B) proving that you lived together.

        i.         i) Letters or
                ii) statements
                        A) from a bank
                        B) that show that
                                I) you
                                        (a) had or
                                        (b) have
                                                (i) a savings or
                                                (ii) checking account
                                                (iii) together.

        j. Insurance papers
                i) that show that
                        A) you
                                I) were or
                                II) still are
                                        (a) covered by your spouse��s insurance plan, or
                ii) that your plan
                        A) covers or
                        B) covered
                                I) him or her.

        k.         i) Bills,
                        A) such as electricity, water, heat, cable TV, phone, or
                ii) others
                        A) that show both you and your spouse��s names.

        l. Income tax papers
                i) that show your name and your spouse��s name.

        m. An identification card
                i) that shows that
                        A) you use your spouse��s last name.

        n.         i) Applications or
                ii) membership cards
                        A) for
                                I) video clubs,
                                II) grocery stores or
                                III) similar businesses,
                        B) that show joint membership
                                I) for your and your spouse.
        o. Any other documents
                i) you can think of
                ii) to show that
                        A) you did not get married
                                I) just to get immigration papers.

2.) How can I show that I am no longer married?

A document
        a) that shows your marriage has been terminated
                i) either through
                        A) divorce,
                        B) annulment, or
                        C) death

1) is evidence
        a) that you are no longer married.

In most cases,

this would be an order
        a) from a judge.

3.)        How can I show that my spouse abused me physically or psychologically?

There are many different ways
        a) to show that
                i) your spouse abused you.

The following is a list
        a) of possibilities:

        a. In your personal declaration,

                you should explain
                        i) how your spouse treated        
                                A) you and/or
                                B) your children.

                If your spouse has ever
                        i) physically harmed or                        
                        ii) beaten you,

                1) describe those incidents.

                Be sure to include
                        i) dates and
                        ii) descriptions
                                A) of any injuries you sustained.

                If your spouse has threatened you
                        i) in any way,
                        ii) including with
                                A) deportation,
                                B) separation from your children,
                                C) death, or
                                D) injuries to
                                        I) you or
                                        II) someone else,

                1) describe these threats.

                If he or she
                        A) has made sexual demands
                                I) on you;
                        B) has denied you economic support;
                        C) has kept you isolated; or
                        D) engages in or
                        E) has engaged in
                                I) any other behavior
                                        (a) that has made you fear
                                                (i) for your own safety or
                                                (ii) for someone else��s,

                1) write as much about this as possible.

                Try to write about
                        A) how it made you feel
                        B) when he has
                                I) threatened,
                                II) hit,
                                III) insulted, or
                                IV) in any other way tried to control you.

                All of this will serve as evidence of
                        A) abuse or
                        B) extreme mental cruelty .

        b. If there are other people
                i) who know about the way
                        A) your
                                I) spouse or
                                II) parent
                        
                             has treated you,

                1) you should present letters
                        A) from these people.

                If there is no one
                        A) you can ask to write a letter for you,

                1) be sure to explain
                        A) why not
                        B) in your declaration.

        c. If,
                i) at any time,
                ii) you or someone else called the police
                iii) because they
                        A) suspected or
                        B) knew
                                I) that your spouse was hurting you,

                1) you should try
                        A) to obtain the police report.

        d.         i) Past or
                ii) present
                        A) court orders
                                I) that prohibit your spouse
                                        A) from approaching you or your children.

        e.         i) Hospital or
                ii) clinic
                        A) reports
                        B) that show that
                                I) you were
                                        A) physically assaulted and/or
                                        B) emotionally harmed
                                                I) by your spouse,

                1) even if you did not tell the person
                        A) helping you
                        B) the truth about how you got hurt.

        f.         i) If                
                        A) you or
                        B) your children

                            have attended a support group
                                I) for survivors of domestic violence, or
                ii) if you
                        A) have or
                        B) continue to see
                                I) a mental health professional,
                                
                1) the support group facilitator or
                2) therapist

                    could write a letter
                        A) to support your case.

                If you have received the assistance
                        A) of
                                I) a shelter or
                                II) other center
                                        (a) for survivors (victims) of
                                                (i) sexual abuse or
                                                (ii) domestic violence,

                1) a staff member
                        A) at the agency

                   could write a letter
                        A) regarding what he or she knows about your case.

4.) How can I show that I will suffer extreme hardship if I have to go back to my country of origin?

One way
        a) to show you are eligible for an I-751 waiver

1) is to show
        a) that you are afraid of
                i) what would happen to you
                ii) if you were returned to your country of origin.

In order to establish your eligibility
        a) under this provision,
1) consider the following:

        a. In your personal declaration,

                1) explain
                        A) what would happen
                                I) to you
                        B) if you had to return to your country of origin.

                For example,

                if you have been a victim of
                        A) domestic violence or
                        B) sexual assault,

                1) describe
                        A) the physical and
                        B) psychological
                                I) consequences of the abuse
                                        (a) you have suffered;
                        C) the impact
                                I) of the loss of access to
                                        (a) United States courts and
                                        (b) criminal justice system;
                        D) your ongoing need
                                I) for social, medical, mental health, or other supportive services;
                        E) the existence of
                                I) laws,
                                II) social practices, or
                                III) customs
                                        (a) in your country
                                        (b) that would punish
                                                (i) you or
                                                (ii) your children
                                                (iii) for
                                                        (A) having been a victim of abuse,
                                                        (B) leaving the situation, or
                                                        (C) taking actions
                                                                (I) to stop the abuse;
                        F) your abuser��s ability
                                I) to travel to the foreign country;
                        G) the likelihood that
                                I) the abuser��s
                                        (a) family,
                                        (b) friends, or
                                        (c) others

                                   would harm you.

        b. If there are other people
                i) who know about
                        A) what would happen to you
                        B) if you had to return to your country of origin,

                1) you should present letters
                        A) from these people.


REMEMBER:

ALL DOCUMENTS MUST BE SUBMITTED
        a) IN ENGLISH OR

        1) HAVE AN ENGLISH TRANSLATION ATTACHED.

YOU MUST INFORM USCIS
        a) OF YOUR CHANGE OF ADDRESSES
        b) WITHIN 10 DAYS
                i) OF MOVING TO A NEW ADDRESS.

SEND ALL DOCUMENTS
        a) TO USCIS
        b) VIA CERTIFIED MAIL

        1) SO YOU CAN HAVE PROOF OF RECEIPT.


C.         WHAT WILL HAPPEN ONCE I HAVE GATHERED TOGETHER ALL OF THESE DOCUMENTS, FILLED OUT THE FORM I-751, AND PAID THE FILING FEE?

Once you have all of your paperwork together,

1) your legal representative will
        a) make copies of everything and
        b) submit it,
                i) along with
                        A) the Form I-751 and
                        B) the filing fee
                                I) (or a fee waiver request),
                ii) to USCIS,
                iii) via certified mail.

Soon after,

your representative should receive a receipt notice
        a) in the mail.

The receipt notice will extend your conditional resident status
        a) for one year.

During that year,

you will be able
        a) to work and
